1. LEGAL ENTITY

1.1 “We”, “us”, or “our” means Gold Tier Advisory Limited, a company registered in England and Wales under company number 15579733. Our registered address is The Harley Building, 77 Cavendish Street, W1W 6XB.

1.2 “You” or your” refers to the individual or business placing an order with us or purchasing goods or services from us.

1.3 You must be at least 18 years old and a resident of the UK to place an order with us.

1.4 Please read these Terms carefully before placing any orders, as they outline essential details about your rights, our obligations and how we operate. By placing an order with us, you confirm that you have read, understood and agreed to these Terms in full.

2. PLEASE NOTE

2.1 You are advised that orders for precious metals are non-cancellable once placed. Due to the nature of the goods and their market-linked pricing, your statutory right to cancel under distance selling regulations does not apply. Further details can be found in Clause 10 of this agreement (“Cancellation Rights”).

2.2 We do not provide financial, tax, or investment advice of any kind. Gold Tier Advisory Limited is not authorised or regulated by the Financial Conduct Authority and does not conduct regulated activities as defined under the Regulated Activities Order 2001 (as amended). Any information provided is general in nature and should not be construed as personalised guidance. You are solely responsible for seeking independent advice from your own accountant, tax adviser, or financial planner before making a purchase decision.

2.3 You acknowledge that the market value of precious metals fluctuate and past performance is not indicative of future results. We make no guarantees that any product purchased from us will increase in value, nor can we guarantee that resale will result in a profit.

4. ORDERING AND PRICING

4.1 All orders placed with us are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion.

4.2 Prices for our goods are subject to market volatility and may change without prior notice. Once your order is confirmed and payment is received, the agreed price is fixed and will not be adjusted.

4.3 You acknowledge and accept that the market value of precious metals fluctuates and that our pricing may reflect factors beyond just the intrinsic value of the metal, including but not limited to numismatic value, rarity, production costs and packaging.

4.4 All prices are quoted in GBP (£) unless otherwise stated and are inclusive of any applicable VAT or duties where relevant. You are responsible for checking whether any local taxes or import charges may apply depending on your jurisdiction.

4.5 No order is deemed final until payment has been received in full and acknowledged in writing by us.

5. PAYMENT TERMS

5.1 Full payment must be received before we can dispatch or allocate any goods. We do not operate on credit and no item will be held or delivered without confirmed cleared funds.

5.2 Payments must be made via bank transfer to the details provided on your invoice, unless otherwise agreed in writing. We do not accept cheque payments under any circumstances, due to market volatility.

5.3 It is your responsibility to ensure that the correct reference is used when making payment. Failure to do so may result in delays in processing your order.

5.4 All funds must originate from an account held in your name. We reserve the right to request further identification and proof of address to verify any payment made.

5.5 Where a deposit is made to reserve goods, that deposit may be deducted from the final balance due, provided full payment is made within the timeframe agreed at the point of sale. Deposits are non-transferable and may be forfeited in the event of cancellation, failure to proceed, or non-communication.

5.6 We reserve the right to cancel any order in the event of non-payment, late payment, suspected fraud, or failure to provide required verification.

6. IDENTIFICATION & COMPLIANCE

6.1 In accordance with UK law and anti-money laundering regulations, we are required to collect and verify identification documents before processing certain transactions. This may include, but is not limited to, photo ID and proof of address.

6.2 We reserve the right to request additional documentation at any time to satisfy our compliance obligations. Failure to provide requested documentation may result in refusal or cancellation of your order.

6.3 We are committed to maintaining the highest standards of due diligence. All client information will be handled in accordance with applicable data protection legislation and used solely for compliance, verification and account management purposes.

6.4 Transactions may be delayed or refused if we suspect unlawful activity or if AML requirements are not met. We reserve the right to report any suspicious activity to the appropriate authorities.

7. AVAILABILITY

7.1 All products are subject to availability. We do not guarantee the continued availability of any item until your order is confirmed and payment is received.

7.2 If a selected product becomes unavailable after payment, we will offer a suitable alternative or a full refund at your discretion.

8. DELIVERY

8.1 We deliver to the address you provide at the time of order. Please ensure all delivery details are accurate and complete.

8.2 Once your order arrives, we recommend inspecting it as soon as reasonably possible. If there are any issues or concerns, notify us promptly so we can assist.

8.3 As soon as your order is delivered, either directly to you or according to your delivery instructions, responsibility transfers to you. From that point on, the goods are considered delivered. We are not liable for any loss, theft, or damage once delivery has taken place.

8.4 Ownership transfers only once full payment has been received and cleared in our account.

8.5 Unless otherwise agreed, delivery timeframes are estimates. If a delay occurs due to events outside our control (such as adverse weather or courier disruption), we’ll notify you as soon as reasonably possible, but we cannot be held responsible for any resulting loss.

9. STORAGE

9.1 We do not provide storage.

9.2 We advise all clients to receive their goods and store them securely, either at home or through a trusted third-party vault.

9.3 Storage remains your responsibility once goods are delivered. Recommendations can be made on request.

10. CANCELLATION RIGHTS

10.1 Due to the nature of precious metals and their price fluctuations, you do not have a statutory right to cancel your order once it has been placed. This is in accordance with Section 28 of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

10.2 We do not accept cancellations or returns unless the goods are proven to be faulty or misdescribed (see Clause 11 - Faulty Goods), or if we have agreed to repurchase your items under our buyback terms (see Clause 12 - Buy Back).

11. FAULTY GOODS

11.1 All goods supplied by us are expected to be as described, of satisfactory quality, and suitable for their intended purpose. We are legally obliged to ensure that your order meets the terms of our agreement with you.

11.2 Should any item arrive damaged or faulty, you must notify us within a reasonable time - ideally within 30 days of delivery - to be eligible for a refund. If you inform us within 6 months (or later if evidence shows the fault was present at the time of delivery), you may request a replacement. We will provide return instructions to facilitate inspection and resolution.

12. BUY BACK - SELLING PRECIOUS METALS BACK TO US

12.1 CONTRACT

12.1.1 You may contact us using the details provided in Section 3 of this document to offer your goods back for repurchase. We are pleased to consider buyback requests on graded items that have been held for 24 months or longer. However, please note - we are under no obligation to accept buyback requests submitted before the 24-month holding period has elapsed.

12.1.2 Once we receive your request, we will inform you whether we are willing to proceed, and if so, provide an indicative offer - subject to the goods meeting our expected standards. This communication is not confirmation of acceptance.

12.1.3 Upon safe receipt and inspection of your goods, we will notify you of acceptance. Only when the goods meet our required condition and we confirm the purchase price, will a binding agreement be formed. If the items do not meet our standard, we may revise our offer, which will require your approval before any payment is made.

12.1.4 We reserve the right to decline any buy back request for any reason. If a request is not accepted, or you choose not to proceed with our offer, we will return the goods to you at the address provided. No payment will be made in such instances.

12.2 PRICE

12.2.1 Precious metal prices move daily - and the value of your goods may be higher or lower than your original purchase price. Should we agree to proceed with your buy back request, we will provide a clear price based on current market rates, confirmed in writing to the contact details you provide.

For graded coins held for 24 months or more, our standard offer is spot price at the time of buy back plus 5%, provided the goods are received in the expected condition.

12.3 PACKAGING AND DELIVERY 

12.3.1 If we confirm a buy back, you will be provided with the appropriate return address. It is your responsibility to ensure the goods are packaged securely and delivered to us safely.

12.3.2 We strongly recommend using an insured, tracked delivery service. We are not liable for any items that are lost or damaged in transit.

12.4 PAYMENT

12.4.1 Once your goods arrive, they will be inspected to ensure they match the agreed condition. If everything is in order, payment will be issued promptly to the bank details you provide.

12.4.2 If there is any discrepancy - in condition, quantity, or authenticity - we will issue a revised offer, which you must confirm before payment is made.

13. EVENTS BEYOND OUR CONTROL

We shall not be held liable for any delay or failure to fulfil our obligations under these Terms where such delay or failure arises from events, circumstances, or causes beyond our reasonable control. This includes, but is not limited to, natural disasters, government actions, market disruptions, courier delays, or supplier constraints.

14. OUR LIABILITY TO YOU

14.1 Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability which cannot be lawfully excluded or limited.

14.2 Subject to the above, we shall not be liable for:

14.2.1 Losses that were not foreseeable by either party at the time this contract was entered into.

14.2.2 Losses not caused by any breach or negligence on our part.

14.2.3 Any business-related losses, including loss of profit, loss of business, or loss of opportunity.

14.2.4 Any losses incurred by non-consumers.

15. THIRD PARTY RIGHTS

These Terms are entered into between you and us. No other person shall have any rights to enforce any of the provisions contained within them.

16. COMPLAINTS

If you are dissatisfied with any aspect of our service or the goods you have received, we encourage you to contact us directly using the details outlined in the ‘How to Contact Us’ section above. We are committed to resolving concerns swiftly and professionally.

If we are unable to resolve your complaint to your satisfaction, you may refer the matter to an Alternative Dispute Resolution (ADR) provider. ADR offers a way to settle disputes without proceeding to court.

Should you choose not to engage in ADR, or if the ADR process does not resolve the matter, you remain entitled to pursue the issue through formal legal proceedings.

17. GOVERNING LAW AND JURISDICTION

17.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales. If you are a resident outside of England and Wales, you may also be entitled to the protection of any mandatory provisions of the laws of your country of residence.

17.2 Any disputes arising in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that legal proceedings may be brought either in England and Wales or in the part of the United Kingdom in which you reside.

18. CLIENT ACKNOWLEDGEMENT

By placing an order with us, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions in full. You acknowledge that this agreement governs your purchase and interaction with Gold Tier Advisory Limited and that no other statements, promises or representations shall override the provisions herein unless confirmed by us in writing.
